FY2011 H-1B Cap Filings
While the FY2010 H-1B cap was just recently hit, the time is now to move forward with new FY2011 H-1B cap fillings. We remind everyone that FY2011 H-1B petitions may be filed on April 1, 2010 requesting an October 1, 2010 start date. This is only 2 months from now, so employers who missed the FY2010 cap should begin planning now for an April 1, 2010 filing date requesting an FY2011 H-1B. Also, any employees who are recent graduates working under Optional Practical Training (OPT) should be reviewed to see if a change to H-1B status is required.
In previous years, CIS has received more then enough H-1B petitions the first week of April to meet the congressionally mandated cap. While the FY2010 cap was not hit until December 2009, there are indications that the volume of H-1B cap filings may return to previous year levels.
