Liebes Forum,
Thorsten
I won the greencard lottery in 2005 and I flew to the US to activate the greencard. I stayed in the US for a couple of days and applied for a reentry permit (by mail), because I wanted to finish my studies in Germany and then return to the US.
The greencard was sent to a friend’s house in the US but for some reason got rejected and I never got any news about the reentry permit.
I went to the US embassy in Tunisia (I was living there) to clarify my situation but an officer told me that I lost my greencard status and that he could not help me. I did not return to the US since the activation of my greencard in 2005.
In 2008 I was selected to do a six month internship in the US. I applied for a B1 visa and stayed in the US for six months on my B1 visa. When I came back (April 2009) I went to the US embassy in Germany to apply for a new B1 visa, because I wanted to return to the US for a job interview (visa wouldn’t be a problem, because it was for a job at UN). The officer told me that I am a permanent resident in the US and that he can’t issue me a B1 and that they made a mistake before when they issued me a B1 visa. He told me to go to the general consulate in Frankfurt.
The officer in Frankfurt said that I need a transportation letter if I want to return to the US but he would not issue it to me as I had received a B1 before. He advised me to enter the US on the tourist waiver programme and then at the port of entry queue up with the greencard holders and explain the officer that I was returning from holidays in Germany. He would be confused and give me an appointment with an immigration judge and the judge would give me a new greencard.
Green card holders are allowed to stay outside the US for a max. of six months. I am thinking about flying to the US within the next four weeks, like the US officer at the general consulate in Frankfurt told me to do.
